Notice is hereby given that in accordance with the Judgment of Foreclosure and Sale entered March 8, 2017 in the action entitled Beneficial Maine Inc. v. Nathan Tapley and Hannah M. Tapley, et al., by the Bangor District Court, Docket No. BANDC-RE-16-4, wherein the Court adjudged the foreclosure of a mortgage granted by Nathan Tapley and Hannah M. Tapley to Beneficial Maine Inc. dated June 14, 2006 and recorded in the Penobscot County Registry of Deeds in Book 10491, Page 48, the period of redemption having expired, a public sale of the property described in the mortgage will be conducted on Thursday, June 7, 2018, commencing at 11:15 AM, at the Law Office of Shapiro & Morley, LLC, 707 Sable Oaks Dr., Suite 250, South Portland, Maine 04106.
Reference is also made to Case No. 17-10375 United States Bankruptcy Court, District of Maine. The period established by 14 M.R.S.A. §6323 to commence publication of this notice of sale was suspended by the automatic stay imposed by 11 U.S.C. §362, the stay in said bankruptcy case having terminated effective March 6, 2018.
The property is located at 36 Allen Street, Bangor, Maine.
The sale will be by public auction. All bidders for the property will be required to make a deposit of $5,000.00 by certified or bank check at the time of the public sale made payable to Shapiro & Morley, LLC, which deposit is non-refundable as to the highest bidder. The balance of the purchase price shall be paid within thirty (30) days of the public sale. In the event a representative of the mortgagee is not present at the time and place stated in this notice, no sale shall be deemed to have occurred and all rights to reschedule a subsequent sale are reserved.
