NOTICE TO BIDDERS/INVITATION TO BID PRESQUE ISLE UTILITIES DISTRICT PARSONS STREET PROJECT

1. RECEIPT OF BIDS The Presque Isle Utilities District will receive sealed bids for the Parsons Street Project at 541A Main Street, Presque Isle, Maine 04769, until 3:00 PM prevailing local time on June 21, 2017, at which time the bids will be publicly opened and read aloud. 2. PROJECT This project includes labor, material and equipment, required for construction, testing, and commissioning of improvements to the existing water and wastewater collection system on Parsons Street, Park Street, and Central Drive, which includes, but is not limited to approximately 1,440 linear feet of 8-inch SDR 35 sewer main, 1,210 linear feet of 6-inch Fusible HDPE service laterals, 3 sewer manholes and 5,065 linear feet of Class 52 12-inch Ductile Iron water main and services and all materials, equipment, services and construction inherent to the Work. The project is funded in part by monies made available by the Drinking Water State Revolving Fund (DWSRF) and administered by the Maine Department of Health and Human Services (DHHS). Any person interested in Bidding on this contract should thoroughly familiarize themselves with the DWSRF Supplemental General Conditions. Failure to comply with any of these conditions may result in the Bidder being determined non-responsive and therefore, not entitled to the award of this Contract. See Contract Documents for full requirements. The Contractor shall be required to substantially complete work within seventy-five (75) calendar days and fully complete the work within ninety (90) days. The Owner intends to issue the Notice of Award within 15 days of the Bid opening. 3. PLANS AND SPECIFICATIONS Plans and Specifications have been prepared by Woodard & Curran Inc., One Merchants Plaza, Suite 501, Bangor, Maine. Plans and Specifications are on file and may be examined at the following locations: Woodard & Curran, Inc. One Merchants Plaza, Suite 501 Bangor, ME 04401 Construction Summary 2331 Congress St Portland, ME 04769 Presque Isle Utilities District 541A Main Street Presque Isle, ME 04769 Copies may be obtained at the office of Woodard & Curran, One Merchants Plaza, Suite 501, Bangor, ME 04401, upon receipt of a non-refundable fee of $75.00 for each set. An additional non-refundable fee of $15.00 must be included if shipping is desired. Shipping shall be via UPS. 4. BIDDER QUALIFICATIONS All Bidders must be able to demonstrate successful experience in completing projects of this size and type if requested. It is the purpose of the Owner not to award this Contract to any Bidder who does not furnish evidence satisfactory to the Owner that the Bidder has the ability, skill, integrity and experience in this class of work, and that the Bidder has sufficient capital and plant to enable the Bidder to execute the same successfully and to complete it within the specified time. 5. DISCLAIMER Any contract awarded under this advertisement to bidders is expected to be funded in part by the Maine Drinking Water Program State Revolving Fund (DWSRF). Neither the State of Maine nor any of its departments, agencies, or employees is, or will be, party to the Contract. 6. BID BOND A certified check or bank draft payable to the Owner or a satisfactory Bid Bond executed by the Bidder and a Surety Company in the amount equal to five percent (5%) of the Bid shall be submitted with each Bid. No bid may be withdrawn for at least 60 days after receipt of bids unless released by the Owner. All such checks will be returned to the respective Bidders within seven (7) days after proposals are opened except those that the Owner elects to hold until the successful Bidder has executed the Contract. Thereafter, all remaining checks, including the check of the successful Bidder, will be returned within ten (10) days of the Contract signing. 7. DISADVANTAGED BUSINESS ENTERPRISE REQUIREMENTS Each Bidder shall take special notice of the Guidance for use of Disadvantaged Business Enterprises in the DWSRF Supplemental General Conditions. Failure to complete these requirements may result in finding that the Bidder is nonresponsive and therefore, not eligible to award of this contract. Complete requirements are located in the Bid Documents. 8. NONDISCRIMINATION IN EMPLOYMENT & EQUAL EMPLOYMENT OPPORTUNITY Bidders on this Work will be required to comply with the President's Executive Order No. 11246 and amendments or supplements to that Order. The requirements for Bidders and Contractors under this Order are located in the DWSRF Supplemental General Conditions. 9. FEDERAL REQUIREMENTS The Contractor must comply with the Department of Labor Regulations relating to Copeland "Anti-Kickback Act (18 U.S.C. 874) as supplemented by 29 CFR part 3, Contract Work Hours and Safety Standards Act (40 U.S.C. 327-330) as supplemented by 29 CFR part 5, and Occupational Safety and Health Standards (OSHA) (29 CFR part 1910). The Contractor must comply with all applicable standards, orders, or requirements issued under section 306 of the Clean Air Act (42 U.S.C. 1857(h)), section 508 of the Clean Water Act (33 U.S.C. 1368), Safe Drinking Water Act, Executive Order 11738, and the Environmental Protection Agency regulations (40 CFR Part 15). The Contractor must comply with all permits, restrictions and conditions, issued for the Project by Federal Cross-cutting Authorities. 10. DAVIS-BACON WAGES The Contractor must comply with Davis-Bacon and Davis-Bacon Related Acts. All laborers and mechanics employed by the contractor and subcontractors on this project shall not be paid less than the prevailing wage rates contained in the wage determination published in the bidding documents. Any laborers and mechanics not listed in the wage determination shall be paid at least as much as the lowest wage rate for other similar trade classifications already contained in the wage determination published in the bidding documents. 11. AWARD OF CONTRACT The Owner reserves the right to reject any or all Bids and to waive any irregularities in bidding. The successful Bidder will be required to furnish the necessary Insurance Certificates. 12. PRE-BID CONFERENCE A Pre-Bid Conference will not be held.
