On January 28, 1981, the United States Environmental Protection Agency (EPA) promulgated the General Pretreatment Regulations at 40 C.F.R. Part 403. These Regulations mandated by the Clean Water Act, 33 U.S.C. ?1251 et seq., govern the control of industrial waste introduced into municipal sewage treatment plants.
Pursuant to the General Pretreatment Regulations, and 06-096 CMR Department of Environmental Protection Chapter 528, Pretreatment Program, the applicant has submitted a request for approval of modifications to its Technically-based Local Limits for Industrial Users. The proposed modifications consist of revisions to current Local Industrial Discharge Limits. Modifications can be reviewed by examining the document entitled City of Bangor Proposed Local Limits (uniform concentration limits). The document can be inspected, Monday through Friday, at the following locations:

As specified in 40 CFR 403.18, and 06-096 CMR DEP Chapter 528 Section 18, substantial modifications to a pretreatment program include modifications that relax POTW legal authorities or local limitations. For Bangor, based on a change in the State of Maine Human Health Water Quality Criteria and the completion of a technically-based local limits evaluation, and the subsequent re-evaluation of the treatment plant's capacity, the City's uniform concentration limit for arsenic is being changed from 0.1 mg/l to 1.93 mg/l. Additionally, the City's uniform concentration limit for Mercury is being changed from 0.02 - 0.01 mg/l. Prior to making a final decision of approval on this request, the DEP Industrial Pretreatment Program Coordinator is providing an opportunity for public comment on the proposed modifications.
Public comments on the proposed modifications should be submitted in writing prior to January 20, 2017 to:

All written comments will be considered in the decision on whether or not to approve the proposed modifications. At the request of the applicant, or if there is sufficient public interest, a public hearing may be held and the time and place of the hearing will be given.
Please note that if no comments to this notice are received, the proposed modifications will be approved without changes and without further public notice. In such event, this public notice shall constitute the "notice of approval or disapproval" required by 403.11(e), and Chapter 528 Section 11(e), and no additional notice shall be provided.
